Hi all. Other than student loans, I don't have a lot of debt. About $10k. Unfortunately, my ex didn't pay our kids' private school bill from several years ago, and I was sued. I also know that they are going to garnish my wages because I had to fill out the paperwork on myself at work (I handle accounting/hr). I honestly wasn't aware of this bill until I was sued. From what I could tell, the maximum amount of my wages that they can garnish would be 30% in Louisiana. From what the lawyers told me, 60% goes toward the bill and 40% to the lawyers. Thing is, each week that goes by, another $25 gets tacked onto the bill. It seems like my wages would be garnished for quite some time.

So I had a meeting with a Bankruptcy lawyer today. I've been a huge fan of Dave Ramsey and I've been paying down my debt. I've done a great job so far, until I was sued. I know he is steadfast against claiming bankruptcy but I don't really see any other option.

My lawyer said that it'll cost $374 for filing up front. Then $200 for the next 36 months. Of that $200, $100 will go to my student loans, $75 to the lawyer, and $25 to a trustee. In all, at the end of the 36 months, I would have paid the lawyer $2700, $900 to the trustee, and $3600 to my student loans. I am currently paying only $40 per month for student loans, so I would actually be paying more to them. Also, he said that the Ch. 13 will stay on my credit for 8 years after my 3 year period ends.

So, I was thinking, I would paid a total of $3,600 to claim bankruptcy thus saving over $6000.

If this company would not garnish my wages, I would definitely pay them off. I've done such a good job so far that it honestly pains me to even THINK about bankruptcy, but I KNOW I would not survive on what would be left over after bankruptcy.

What do you guys think? What else do I need to know about bankruptcy? Is there any alternative to bankruptcy that would stop my wages from being garnished? Anything that you can share would be a HUGE help. Thanks :)
